Terms of Service — VibeComments

1. Agreement

These Terms govern your use of VibeComments — the browser extension for leaving comments on live web pages, the sync service behind it, and the website at vibecomments.com. By installing or using VibeComments you agree to them. If you do not agree, do not install it, or uninstall it.

In these Terms, “VibeComments”, “we” and “us” mean the operator of the VibeComments extension, sync service and website. You can reach us at support@vibecomments.com.

You must be at least 16, or the age of digital consent where you live if that is higher, and able to enter into a binding contract. If you use VibeComments for an employer or client, you confirm you are authorised to accept these Terms on their behalf, and “you” means both you and them.

2. What VibeComments does

VibeComments puts a comment on an element of a page you have open, and keeps the element with the comment. Today that means:

Click an element on any URL your browser can open — localhost, a preview, or the site you shipped — and write what should change
The comment carries its anchor, so it points at that element rather than at the page, plus an optional cropped screenshot of it
Copy every open comment as one block, for a coding agent to work through
With an account: threads on the element, replies from teammates, an organisation with projects inside it, each project scoped to its own URLs, and members added as editor or viewer

Anything described anywhere as planned, upcoming or “soon” is not part of what you are getting — including the MCP server, which is built but not published. This describes VibeComments today. It is a description, not a promise. See section 11.

3. What alpha means

Read this section carefully. It is the most important clause on the page, which is why it is near the top.

VibeComments is pre-release software. Features change and are sometimes removed.
Data loss is possible. The sync service can be restarted or reset while we work on it, and open connections do not survive that. Local data can be lost by clearing browser data, uninstalling, resetting a browser profile, or a browser bug.
An anchor can go stale. When the page a comment points at changes, the comment may no longer resolve to the element you meant.
There is no uptime commitment. The sync service and this website may be unavailable for maintenance, outages, or reasons outside our control.

Do not rely on VibeComments as the only record of anything you cannot afford to lose. Comments you need to keep should be copied somewhere you control — which the one-click copy is designed to make easy.

4. Your responsibilities

You agree that you will:

Only use VibeComments on pages you have the right to view and to share what you capture from
Keep your own copy of anything you cannot afford to lose, per section 3
Comply with the law and with any duty you owe to your employer, client, or users

You will not:

Use the service to store or distribute unlawful content, malware, or material you have no right to
Attempt to access another account, organisation, project, or comment you were not given access to
Interfere with the service — probing, load-testing, or circumventing rate limits — without our written agreement. Security research is welcome; write to us first
Reverse engineer, decompile, or tamper with the extension, or resell, sublicense, rent or redistribute it

The extension injects an annotation layer into pages you open it on. That is what it is for. You are responsible for having the right to do this on any site that is not yours, and for complying with any agreement you have with that site’s operator.

5. Accounts, organisations and projects

The extension works with no account. If you create one, you are responsible for the email address it is tied to and for what happens under it. Tell us at support@vibecomments.com if you believe someone else has access to it. Authentication is a six-digit code sent to that address; there is no password.

An organisation owner controls who is in the organisation, which projects exist inside it, and what role each member holds on a project — editor or viewer, with the owner being whoever created it. Adding somebody to a project shares that project’s comments with them. Each project is scoped to its own URLs.

6. Your content

The comments you write are yours. You keep all rights to them. You grant us only the permission required to run the service: to store your comments, to show them to the people you shared them with, and to make them available to the tools you connect — including a coding agent you point at your own comments.

You are responsible for what you put in a comment. Do not put anything in one that you do not have the right to share, and be aware that a comment is anchored to a URL: if you comment on a page containing someone else’s confidential or personal data, and you capture an element screenshot of it, that data travels with the comment.

7. Ownership and your licence

VibeComments, its code, design, name, and logo are ours and stay ours. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use VibeComments under these Terms. Nothing here transfers ownership of anything to you.

8. Price

Alpha access is free and no payment details are collected. There is no billing running today, and nothing on this site charges you.

A Teams price is published on this site so you can see where this is going. It is an intention, not an invoice: it does not apply to you until you agree to it. If a paid tier is introduced we will say so before it applies, and we will not convert free alpha access into a charge without your explicit agreement.

9. Your data

Signed out, your comments, settings and screenshots live in your browser’s own extension storage. We have no copy and cannot recover them. Signing in creates a server-side copy so that a comment can reach a teammate.

What is collected, what is never collected, who processes it, and how to have it deleted are set out in the Privacy Policy, which forms part of these Terms.

10. No warranty

To the fullest extent the law allows, VibeComments is provided “as is” and “as available”, with all faults, and without warranties of any kind, whether express, implied, or statutory. We specifically disclaim any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment.

We do not warrant that a comment will resolve to the element you meant, that the extension will work on any particular website, that the service will be uninterrupted, secure, or error-free, or that defects will be fixed. No advice or information you get from us creates any warranty not stated here.

11. We may change or discontinue VibeComments

VibeComments evolves. We may add, change, limit, or remove any feature at any time, including features described on this website. We may also discontinue VibeComments entirely. If we discontinue the sync service, we will give account holders reasonable notice and a way to export their comments.

Browsers change too. Chrome, Edge, Firefox and their extension stores may change their rules or remove extensions, and that may force us to change or withdraw features. That is outside our control and is not a breach of these Terms.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for:

Loss or corruption of comments, replies, screenshots or settings, local or synced
Any disclosure of data that happens because you captured it in a comment or an element screenshot and shared it
Indirect, incidental, special, punitive, or consequential damages
Lost profits, lost revenue, lost business, lost goodwill, or reputational harm
The acts, outages, or failures of third parties, including those listed in section 15

Our total aggregate liability for all claims relating to VibeComments is limited to the amount you actually paid us in the twelve months before the claim, and is zero while access is free. You get the product for nothing during the alpha, and this cap is part of the bargain.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or for anything else mandatory law says cannot be limited. Nothing here limits the mandatory consumer rights you have under the law of your country of residence.

13. Indemnity

You will indemnify us and hold us harmless from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or connected with: your use or misuse of VibeComments; the pages you annotate and what you capture from them; your breach of these Terms; or your breach of any law or of any right of a third party.

This does not apply to the extent the claim is caused by our own fraud, gross negligence, or wilful misconduct, or where mandatory law says otherwise.

14. Suspension and termination

You may stop using VibeComments at any time; uninstalling the extension is enough, and it removes the local data with it. Account deletion is described in the privacy policy.

We may suspend or end access immediately for a serious or repeated breach of these Terms, and where circumstances allow we will tell you why first. Sections that by their nature should survive do survive termination, including sections 3, 6, 7, 10, 12, 13 and 16.

15. Third parties

Running the service means relying on other people’s: the services behind accounts, email, hosting and the database, and the browser extension stores that distribute the extension under their own terms. They operate under their own terms and we do not control them. We are not responsible for their acts, omissions, outages, or policy changes.

16. General

Force majeure: we are not liable for any failure caused by something outside our reasonable control, including outages, network failures, attacks, browser or store policy changes, and acts of government.
Severability: if any part of these Terms is held invalid or unenforceable, it is limited or removed to the minimum extent necessary, and the rest stays in force.
No waiver: if we do not enforce a right, that is not a waiver of it.
Assignment: we may transfer these Terms and the service, for example if VibeComments is acquired. You may not transfer your rights under these Terms.
Feedback: if you send us ideas, suggestions, or feedback, we may use them freely, without obligation, attribution, or payment to you.
Entire agreement: these Terms and the Privacy Policy are the whole agreement between us about VibeComments, and replace anything said or written before.

17. Changes to these Terms

We may update these Terms as VibeComments changes. The effective date at the top of this page always reflects the current version, and a material change will be announced by email to account holders before it takes effect. Continuing to use VibeComments after an update means you accept the new Terms.
